TERMS AND CONDITIONS OF THE “LOVEDROPS POINTS BY LOVEGASM” LOYALTY PROGRAM

1. PROMOTING COMPANY

The promoter of the “Lovedrops Points” loyalty program (the “Program”) is Lovegasm, a trading name of BENBIS ENTERPRISES LTD, with registered office at 124 City Road
LONDON, EC1V 2NX. With ID number 11191116, owner and operator of the e-commerce website www.lovegasm.co.uk

The Program is managed through Smile.io, the technology platform used by Lovegasm to administer loyalty points, rewards and referrals.

2. ELIGIBLE PARTICIPANTS

The Program is available to customers who are legally entitled to participate and who have a customer account on www.lovegasm.co.uk

Participation is subject to these Terms and Conditions, as well as Lovegasm’s applicable Terms of Sale and other policies available on the website.

Lovegasm may apply geographical restrictions where required by applicable law, shipping conditions or the nature of specific rewards.

3. TYPE OF PROGRAM

The Program is a customer loyalty and rewards program based on the accumulation of points and the redemption of points for discounts and other rewards.

The Program is called “Lovedrops Points.”

Points and rewards are administered through Smile.io and are associated with the participant’s Lovegasm customer account.

4. PURPOSE OF THE PROGRAM

The purpose of the Program is to reward customer loyalty, encourage purchases and engagement with Lovegasm, and provide participants with benefits and rewards based on their activity on the Lovegasm website.

5. PROGRAM DURATION

The Program will begin on 1st August 2026 and will remain in effect unless Lovegasm decides to modify, suspend or terminate it in accordance with these Terms and Conditions and applicable law.

Any material changes affecting participants’ rights will be communicated through the channels available to Lovegasm.

6. COMMUNICATION OF THE PROGRAM

The Program may be promoted and communicated through:

  • www.lovegasm.co.uk

  • the Lovegasm loyalty panel;

  • email communications;

  • Lovegasm social media accounts;

  • newsletters and other marketing communications;

  • promotional materials published by Lovegasm.

Any promotional communication relating to the Program should be read together with these Terms and Conditions and with any specific terms displayed for individual rewards or promotions.

7. HOW THE PROGRAM WORKS

The Program allows participants to accumulate Lovedrops Points through eligible purchases and other activities made available by Lovegasm.

The Program is administered through Smile.io, which is integrated into the Lovegasm online store.

Participants can view their points balance, available rewards and relevant loyalty activity through the loyalty panel associated with their Lovegasm account.

7.1. Earning Points Through Purchases

For every €1 spent on eligible purchases at Lovegasm, the participant earns:

5 Lovedrops Points.

Examples:

  • €1 spent = 5 Lovedrops Points

  • €10 spent = 50 Lovedrops Points

  • €20 spent = 100 Lovedrops Points

  • €100 spent = 500 Lovedrops Points

Points are calculated based on the portion of the purchase that is eligible for points according to the Program rules and Smile.io configuration.

Unless expressly stated otherwise, points will not be awarded on shipping fees, taxes, discounts, gift cards, refunded orders, cancelled orders or any other items specifically excluded by Lovegasm.

Points earned from a purchase may initially remain pending until the order has been completed and is no longer subject to cancellation or return, in accordance with the Smile.io configuration.

If an order is subsequently fully or partially refunded, Lovegasm may deduct the points corresponding to the refunded amount.

7.2. Value of Lovedrops Points

Lovedrops Points do not constitute electronic money, a cash balance, a deposit or an independent means of payment.

For redemption purposes:

100 Lovedrops Points = €1 discount.

Examples:

  • 100 points = €1 discount

  • 500 points = €5 discount

  • 1,000 points = €10 discount

  • 2,000 points = €20 discount

Points may only be used to obtain the rewards made available through the Program and cannot be exchanged directly for cash.

7.3. Free Shipping Reward

Participants may use their points to obtain rewards consisting of free shipping, where such reward is available through the Lovedrops Points loyalty panel.

Unless otherwise specified:

1000 Lovedrops Points = Free Shipping reward.

The Free Shipping reward is subject to the conditions displayed at the time the reward is issued or redeemed, which may include eligible destinations, available shipping methods, minimum order values, product exclusions and other applicable shipping conditions.

The Free Shipping reward cannot be exchanged for cash or another benefit unless Lovegasm expressly provides otherwise.

7.4. Other Rewards

Lovegasm may make additional rewards available through Smile.io, including but not limited to:

  • monetary discounts;

  • free shipping;

  • special promotions;

  • exclusive rewards;

  • loyalty benefits;

  • rewards linked to specific customer actions or loyalty levels.

The specific terms applicable to each reward will be displayed in the loyalty panel when the reward is made available.

Lovegasm may modify the rewards offered under the Program from time to time. Such changes will apply to future rewards and promotions.

8. REFERRAL PROGRAM

Participants may earn additional rewards by referring new customers to Lovegasm through the referral functionality provided by Smile.io.

Through the loyalty panel, participants may share their personal referral link via:

  • Facebook;

  • X;

  • email;

  • other social media platforms;

  • SMS;

  • WhatsApp;

  • copying and pasting the referral link into other communication channels.

8.1. How Referrals Work

The participant may share their personal referral link with a friend who has not previously made a purchase that would make them ineligible for the referral offer.

When the friend clicks the referral link, they will be redirected to the Lovegasm store.

The friend will be asked to enter their email address in the relevant pop-up or form in order to receive their reward or discount code by email.

The friend must manually enter or copy and paste the discount code during checkout in order for the reward to be applied to their purchase.

8.2. Referral Reward

A referral is considered completed only when the referred friend makes a qualifying purchase using the reward/discount code associated with the referral.

Once the qualifying purchase has been completed and validated, the referring participant will receive:

€3 off, equivalent to 300 Lovedrops Points, subject to the applicable Smile.io configuration.

The referring participant may view the reward in the loyalty panel, including under the relevant My Rewards section.

The participant may also receive an email notification confirming that their friend has completed a purchase using the referral reward code.

8.3. Referral Conditions

Referral rewards may not be generated through fraudulent, abusive or artificial activity.

Lovegasm may cancel or refuse a referral reward in cases including, but not limited to:

  • duplicate or fictitious accounts;

  • self-referrals;

  • use of false or misleading information;

  • fraudulent use of referral codes;

  • purchases made primarily for the purpose of generating a referral reward and subsequently cancelled or refunded;

  • manipulation of the referral system;

  • any other activity intended to obtain a reward contrary to the intended operation of the Program.

Participants may not use their own details, accounts, payment methods or other means to artificially generate referral rewards.

9. REDEMPTION OF POINTS AND REWARDS

Lovedrops Points may be redeemed exclusively in accordance with the conditions applicable to the Program and displayed through the Lovegasm loyalty panel.

Rewards may be subject to specific conditions, including:

  • minimum purchase requirements;

  • excluded products or categories;

  • expiration dates;

  • usage limitations;

  • restrictions on combining rewards or discount codes;

  • geographical or shipping restrictions.

The conditions applicable to a reward will be displayed to the participant when the reward is issued or redeemed.

Unless expressly stated otherwise, rewards and discounts cannot be exchanged for cash.

10. RETURNS, CANCELLATIONS AND REFUNDS

If a purchase has generated Lovedrops Points and that purchase is subsequently cancelled, refunded or returned, Lovegasm may adjust or deduct the corresponding points.

If a purchase made using a reward or discount is subsequently returned, any refund will be processed in accordance with Lovegasm’s applicable Terms of Sale and Return Policy.

Any reward obtained through a transaction that is subsequently cancelled, refunded or determined to be fraudulent may also be cancelled.

11. EXPIRATION OF POINTS

Lovedrops Points are subject to the expiration rules applicable to the Program and/or Smile.io.

Annual Expiration of Points
The Lovedrops Points Program will remain active indefinitely until terminated or discontinued by Lovegasm. Points are valid only until the end of the calendar year in which they are earned. On December 31 of each year, all unused Lovedrops Points will expire and the participant’s points balance will be reset to zero. A new points accumulation period will begin on January 1 of the following year.

If the Program is permanently terminated, Lovegasm may communicate any applicable conditions and deadline for redeeming existing points and rewards.

12. POINT AND REWARD MANAGEMENT

The participant's Lovedrops Points balance and available rewards can be viewed through the loyalty panel integrated into their Lovegasm account.

Smile.io is the technology platform used to administer the Program, including, where applicable:

  • recording points;

  • issuing rewards;

  • managing referrals;

  • displaying loyalty activity;

  • tracking rewards.

In the event of a discrepancy between the displayed points balance and the participant's actual eligible activity, Lovegasm may verify the relevant transactions using its own systems and the information provided by Smile.io.

13. FRAUD, ABUSE AND LOSS OF REWARDS

Lovegasm may cancel points, rewards, discount codes or other benefits obtained through fraud, abuse, manipulation or violation of these Terms and Conditions.

Prohibited or abusive practices include, without limitation:

  • creating fictitious or duplicate accounts;

  • self-referrals;

  • manipulating the points system;

  • exploiting technical errors;

  • using automated or unauthorized methods to interact with the Program;

  • using fraudulently obtained codes;

  • systematically returning orders for the purpose of retaining rewards;

  • any other activity intended to obtain benefits that are not legitimately earned under the Program.

Where appropriate, Lovegasm may temporarily suspend or permanently terminate a participant's access to Lovedrops Points.

14. MODIFICATION, SUSPENSION OR TERMINATION OF THE PROGRAM

Lovegasm reserves the right to modify the rules, rewards, point values, earning rates, redemption conditions or other aspects of Lovedrops Points, as well as to suspend or terminate the Program, where there is a legitimate reason or where this is necessary for legal, technical, commercial or operational reasons.

Material changes will be communicated through appropriate channels.

Unless required by applicable law or justified by exceptional circumstances, changes to the Program will not affect rewards that have already been validly redeemed.

15. PERSONAL DATA

Participation in Lovedrops Points involves the processing of personal data necessary for the administration of the loyalty program, including information relating to the participant's customer account, loyalty activity, points balance, rewards and, where applicable, referral activity.

Personal data will be processed in accordance with applicable data protection legislation, including, where applicable, the EU General Data Protection Regulation (GDPR).

Where necessary for the technical operation of the Program, certain personal data may be processed by technology providers acting as processors or service providers on behalf of Lovegasm, in accordance with applicable data protection legislation.

For full information regarding the processing of personal data, data retention, user rights and third-party service providers, participants should consult the Lovegasm Privacy Policy available on the website.

16. LIABILITY

Lovegasm shall not be responsible for the inability to use points or rewards where such inability results from circumstances outside its reasonable control, including technical interruptions, internet connection failures, temporary unavailability of Smile.io or technical problems affecting third-party services.

Lovegasm will take reasonable measures to restore the normal operation of the Program following technical incidents.

17. NATURE OF LOVEDROPS POINTS

Lovedrops Points are loyalty units intended exclusively to obtain the rewards made available through the Program.

Points:

  • do not constitute money;

  • do not constitute a monetary deposit;

  • do not generate interest;

  • may not be sold;

  • may not be transferred to another account unless Lovegasm expressly enables such functionality;

  • may not be redeemed directly for cash;

  • may only be used in accordance with the rules of the Program.

18. ACCEPTANCE OF THESE TERMS

Participation in Lovedrops Points constitutes acceptance of these Terms and Conditions.

By participating in the Program, the participant confirms that they have had access to the Program rules and accepts the conditions relating to the earning, redemption and expiration of Lovedrops Points and rewards.

19. FINAL PROVISIONS

Any matters not expressly covered by these Terms and Conditions shall be governed by Lovegasm's Terms of Sale, Privacy Policy and other applicable policies published on the website, as well as by applicable law.
